CONDITIONS OF SALE

1. Scope of these Conditions

These conditions apply to the sale of the goods specified in the online order, confirmed via email by Mobility Retail (UK) LTD Trading as: Rushmere Mobility (“the company”) to you from purchases via https://www.rushmeremobility.co.uk

2. Price and Payment

The price of the goods payable by you is set out in the website with totals confirmed at the checkout. The price is exclusive of VAT except at the checkout, which will be payable in addition to order value unless you have completed the VAT Exemption Criteria at the checkout.

3. Delivery of Goods

Delivery of the goods will be made to your address on the anticipated delivery date specified on your order. You must make all arrangements necessary to take delivery of the goods whenever they are tendered for delivery. The company will do all that it reasonably can do to meet the date given for delivery. If the company is not able to deliver the goods on the delivery date specified on the order form, the company will will contact you to give an alternative date. If you are not able to take delivery of the goods on the delivery date, you must contact the company to arrange an alternative date.

4. Risk of Property

Ownership of the goods transfers to you either when payment in full has been given to the company (or when an agreed financing option is in place, this only applies to non website related sales). Responsibility for goods will transfer from the company to you when they are delivered.

5. Notification of Faults

You must examine the goods as soon as reasonably possible after a delivery and notify the company of any fault or damage as soon as possible.

6. Governing Law

These conditions are governed by the law of England and Wales.

7. Warranties and Liabilities

You have a right in law to expect goods 1) of a satisfactory quality, 2) as described and 3) fit for the purpose you make known to us when we supply the goods to satisfy that purpose. However, in addition to this, the company warrants that the goods will correspond with their specification at the time of delivery and will be free from defects in material and workmanship for the following periods of time as defined below are from the date of delivery:

1 Year for all comfort range riser recliner chairs, stairlifts and fabrics or leather upholstery on any and all riser recliner chairs or adjustable beds supplied by the company.

2 Years for any and all mattresses for adjustable beds supplied by the company.

3 Years for electrical and mechanical cover for both the chatsworth, and the colworth adjustable beds supplied by the company.

5 Years for electrical and mechanical cover on all premier range riser recliner chairs and also the cardington and the shortmead adjustable beds supplied by the company.

10 Years for electrical and mechanical for all of the premier range adjustable beds supplied by the company.

The above, is valid PROVIDED ALWAYS that in the case of any items which are stated on the order form as being “optional extras” such warranty will only apply for a period of of one year from the date of delivery.

The company will not have any responsibility for any defect caused by wear and tear, wilful damage, negligence, abnormal working conditions, failure to follow the company’s reasonable guidelines and instructions (where oral or in writing) or misuse, alteration or repair of the goods without the company’s written approval.

8. Breakdown

In the event of a breakdown please call 0800 195 1338 and we will arrange for an engineer to call. If a breakdown is not the fault of the company and is caused by you, a third party or by an event that is beyond the reasonable control of the company. The standard callout charge of £75 + VAT will be made to cover the company’s expenses in providing an engineer.

9. Notice of the Right to Cancel

You have the right to cancel this contract within a period of 14 days starting from the contract date and may do so by personally delivering or sending a letter, or by email:

The notice of cancellation is deemed to be served as soon as it is delivered, posted or emailed.

Any related credit agreement will be automatically cancelled if this contract is cancelled.
